These Terms of Service ("Terms") govern your access to and use of LinkForty's services, website, and applications (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

1. Service Description

LinkForty provides a cloud-based deeplink and URL management platform that enables users to:

• Create and manage short links
• Configure mobile deep linking with platform-specific routing
• Track analytics and click events
• Manage custom domains
• Collaborate with team members
• Access programmatic API endpoints

2. Account Registration

To use the Service, you must:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Be at least 18 years old or the age of majority in your jurisdiction
• Notify us immediately of any unauthorized access to your account
• Be responsible for all activities that occur under your account

3. Subscription and Billing

3.1 Subscription Plans

We offer multiple subscription tiers:

• Free Plan: Limited features with usage restrictions
• Pro Plan: $19/month - Enhanced limits and features
• Business Plan: $49/month - Expanded limits for growing teams
• Unlimited Plan: $149/month - Unlimited usage with premium support

3.2 Billing Terms

• Subscriptions renew automatically unless canceled
• Prices are in USD and exclude applicable taxes
• You authorize us to charge your payment method on each billing cycle
• Failed payments may result in service suspension
• We reserve the right to change pricing with 30 days notice

3.3 Refund Policy

All subscription fees are non-refundable. We provide the following options to evaluate our service before committing to a paid plan:

• Free Plan: Available indefinitely to test core features with usage limits
• Free Trial: Paid plans include a trial period to evaluate premium features before being charged
• Cancellation: You may cancel your subscription at any time; access continues until the end of the current billing period
• No Pro-rated Refunds: We do not provide refunds or credits for partial billing periods
• Exceptions: Refunds may be issued at our sole discretion for billing errors or technical issues preventing service access

By subscribing to a paid plan, you acknowledge that you have had the opportunity to evaluate the service through our free plan and/or trial period.

4. Acceptable Use and API

4.1 Prohibited Uses

You agree NOT to use the Service to:

• Violate any laws or regulations
• Infringe intellectual property rights
• Distribute malware, viruses, or harmful code
• Create links to illegal content, phishing sites, or malicious websites
• Spam or send unsolicited communications
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Generate, submit, or attempt to attribute fraudulent clicks, installs, opens, or conversion events — including but not limited to click spam, click injection, install farms, and SDK spoofing
• Modify, intercept, replay, or falsify any data transmitted by the LinkForty SDK or API
• Use the Service to circumvent platform policies (Apple App Store, Google Play, or other distribution platforms) including their attribution, tracking, and identifier-use rules (e.g., Apple's App Tracking Transparency framework and SKAdNetwork/SKAN constraints)
• Access or use the Service through any automated means, including but not limited to any robot, spider, crawler, script, browser extension, site search or retrieval application, or other automated device, process, or means to access, retrieve, scrape, or index any portion of the Service, without our express prior written consent
• Resell or sublicense the Service without authorization

4.2 API Usage

If you use our API:

• You must comply with rate limits (documented in API documentation)
• You must use API keys securely and not share them
• You are responsible for all API activity under your account
• Excessive usage may result in rate limiting or service suspension
• We may modify API endpoints with reasonable notice

5. Data and Content

5.1 Your Content

You retain ownership of your content (links, analytics data, team data). You grant us a license to use, store, and process your content to provide the Service.

5.2 Our Rights

We may review, monitor, or remove content that violates these Terms. We reserve the right to suspend or terminate accounts that repeatedly violate our policies.

5.3 Data Backup

While we maintain regular backups, you are responsible for maintaining your own backups of important data.

6. Intellectual Property

The Service, including its design, code, logos, and documentation, is owned by LinkForty and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or reverse engineer any part of the Service.

7. Disclaimers and Limitation of Liability

7.1 Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted access. We may perform maintenance with reasonable notice. We are not liable for downtime, service interruptions, or data loss.

7.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LINKFORTY SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Any damages exceeding the amount paid by you in the past 12 months
• Third-party actions or content
• Unauthorized access to your account due to your negligence

7.3 Indemnification

You agree to indemnify and hold harmless LinkForty from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

8. Termination

8.1 By You

You may cancel your subscription at any time through your account settings. Upon cancellation:

• Your subscription remains active until the end of the billing period
• You will not be charged for subsequent periods
• You may export your data before the subscription ends

8.2 By Us

We may suspend or terminate your account for:

• Violation of these Terms
• Non-payment of fees
• Fraudulent or illegal activity
• Extended inactivity (Free accounts only)

9. Legal

9.1 Governing Law

These Terms are governed by the laws of the State of Utah, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Utah.

9.2 Dispute Resolution

In the event of a dispute, you agree to first attempt informal resolution by contacting our support team. If unresolved within 30 days, disputes may be submitted to binding arbitration.

9.3 Changes to Terms

We may modify these Terms at any time. Material changes will be notified via email or in-app notification at least 30 days before taking effect. Continued use of the Service after changes constitutes acceptance.

9.4 Privacy

Our Privacy Policy explains how we collect, use, and protect your data. By using the Service, you agree to our Privacy Policy.

9.5 Miscellaneous

• Entire Agreement: These Terms constitute the entire agreement between you and LinkForty
• Severability: If any provision is found invalid, the remaining provisions remain in effect
• Waiver: Failure to enforce any provision does not waive our right to do so later
• Assignment: You may not assign these Terms; we may assign them with notice
• Force Majeure: We are not liable for delays due to circumstances beyond our control

9.6 Feedback

If you provide us with any feedback, suggestions, ideas, or other input about the Service ("Feedback"), you grant LinkForty, Inc. a perpetual, irrevocable, worldwide, royalty-free, fully paid-up, sub-licensable, and transferable license to use, reproduce, modify, create derivative works from, distribute, and display the Feedback for any purpose, without any obligation or compensation to you. You represent that you have the right to provide such Feedback.
